Subject: Divorce letter and no reply

Got a letter from spouse via court asking for divorce on ground that we have been living apart for 2yrs. what would happen if i ignore the court devorce letter?. I dont want to reply the letter.please what would happen?

Eventually after 5 years apart she can divorce you without your consent or she could divorce you now on grounds of unreasonable behaviour. You have no legal obligation to reply to the letter. They might get a service agent to serve a divorce petition on you however.

no asset, nothing togather and she is not making any financial claims according to court notice. I just dont want her to know where i am cos she is very violent

You could instruct your sol (or rep) to not display your address or have your paperwork sent to a 3rd party...

She doesn't need to know where you are. Contact the court and ask officials for the appropriate form to withhold your address because of DV.

There should have been an Acknowledgment of Service, Form D10, enclosed with the papers. If there isn't contact the court. Generally speaking there isn't much point in defending or ignoring a divorce petition. Although you have no assets and she isn't making financial claims unless you deal with the divorce and future claims are dismissed it is still possible for both parties to make claims against each other. Recently a woman was awarded £120k?? of her husband's inheritance 22 years after separation!

thanks.no form came with it. I will look for a lawyer to help me contact court, is it possoble for a lawyer to help me and use their chamber address instead of mine for the corresponence.Any idea of how much this service might cost me..just a guide would help

The D10 can be downloaded from www.hmcs.gov.uk along with the other form to restrict your address.

And yes a solicitor can be used to file these papers and cost depends on which ever practice you choose my solicitor is quite expensive but he is really good and been practicing for 40yrs. My divorce this year has cost me and my parents 10K sorry if that frightens you but I have an a**e for and ex husband who thinks it's ok to ask irrelevant questions that he has answers too already so I hope yours doesn't do the same.

Another form to download and print is a Form E this is a 28page document that lists assets and liabilities and can take a while to fill out I would suggest that you do this yourself with help from here as if your sol does it that will cost a fortune. It's long but quite easy to do if your finances are already seperate.

Check in your area to see which solicitor offers a 1/2 or hour free service to gauge whether you can work with them and take a list of questions to save time and money.

Not all the forms are available on the HM Court Services website. Form D10 isn't available and I don't think the form requesting that your address to be kept confidential is either. You will need to contact the court directly.
