Subject: Increasing Contact
Posted By easyrider on 18-01-2010
Hi. New here. I have had 2 nights overnight contact with my 4 year old child for the past 3 months. When is going to be a good time to ask for more ie to progress to 3 then 4 nights and then half of holidays? I know that EX will not agree it at all. I know I will need to go back to court but just wondering when to apply. Someone said I soud wait at least 6 months then ask for it to be increased. Can I apply now and by the time this goes to court 6months will have passed?

from friday after school to 6pm on sunday alternate weekends. I am worried going back to court to early and things back firing on me.

Hi,
My daughter is nearly 4. I have alternate sat 9am through to Sun 5.30pm. This situation has been the case for 19 months. I am applying to court for Fri through Sun alt weeks and provision around holidays.
I see no harm in resolving holidays but I suspect you won't get any more than your current contact at this stage. I don't believe 3 months will be deemed sufficient to increase contact further. That's just my view and the advice I've been given. However I have left it too long for increasing my contact, I should have applied after 12 months.
Good Luck!

If the order is for Fri - Sun alternate weekends why have you only had overnight contact twice in the last three months? You need to establish the contact which is actually ordered before thinking of an increase. If the order is being breached and the matter cannot be resolved any other way you can to make an application in relation to enforcement, Form C79. The court fees is £80 and a guide (CB5) is available to download from HM Courts website.

I would say wait 6 months and then maybe apply with a view to extending the time to gradually build up holidays. Perhaps longer alternate weekends, then 5 or 6 days and a full week at a time this year then 10 days and two weeks next year.
